Thorne-Leggett Terms and Conditions

Definitions & Interpretations

Applicant/Client: The person(s) making and confirming the funeral arrangements and responsible for signing the estimate form which forms the contract between the Client(s) and Thorne Family Funerals Limited.

Thorne-Leggett: Thorne Family Funerals Ltd, trading as Thorne-Leggett Funeral Directors

Estimate: means a written indication of the charges likely to be incurred for professional fees and third party fees and may be subject to change.

Third Party fees: means a payment made to third parties on your behalf, including but not limited to, minister and church fees, doctors’ fees, cemetery / crematorium fees, newspaper notices and printing of service sheets.

Final account: The total price payable by client/applicant for professional fee and third party fees and all works carried out by Thorne-Leggett Funeral Directors.


Estimates & Charges

Thorne-Leggett’s estimates set out the services we agree to supply. This estimate is an indication of the fees likely to be incurred on the basis of the information and details we know at the date of the arrangement. While we make every effort to ensure the accuracy of the estimate, the fees are liable to alteration particularly where third parties change their rates or charges.

We may not know the amount of the third party fees in advance of the funeral; however, we give you a best estimate of such fees in the written estimate. The actual amount of the fees will be detailed and shown in the final account.

If you amend your instructions then Thorne-Leggett may need to make extra charge(s) in accordance with the prices published in our current price list. Thorne-Leggett may also need to make additional charges where extra staff and equipment may be needed on Health & Safety grounds.

In the event that the precise product and services you have specified are not available then products and services of at least equivalent quality will be provided at the cost shown on the estimate.

Thorne-Leggett will usually cover the costs of third party fees in advance of the funeral. However, Thorne-Leggett reserves the right to ask for payment in advance for some or all of the third party fees in advance of the funeral, especially if the third party fees amount to over 50% of the total funeral costs.


Payment of account

Once Thorne-Leggett has carried out the funeral and completed all arrangements a final account will be sent to the client/applicant for payment. The funeral account will normally be sent some 7 days after the funeral and payment of the account is required within 30 days of the date of the account by the client/applicant. Any extension to this time period is only allowed with the written permission of one of the company directors.

Thorne-Leggett are happy to discuss the various options open to those who are suffering financial difficulty. However those applicants/clients who do not make it clear from the outset that there may be some difficulty in finalising payment of the account will still be liable to pay the account in full.

In some instances Thorne-Leggett may be requested to divide the funeral account between several parties for payment. Thorne-Leggett are happy to oblige this request; however, the applicant/client is the person ultimately responsible for payment of the total account

If payment is not made within the 30 day period or if the client/applicant fails to adhere to any payment agreement entered into with the permission of a company director then Thorne-Leggett reserve the right to charge interest at the rate of 5% above the RBS minimum lending rate per calendar month and also reserves the right to recover the debt through a third party debt recovery agency. The client/applicant will then be responsible for all costs incurred by Thorne-Leggett from the debt recovery agents and we will apply to the courts that all legal costs, court fees and other incidental fees and interest occurred be covered by the debtor.


Right to Cancel

If the funeral is arranged in the client/applicants home then they are covered by the Cancellation of Consumer Contracts Regulations Act 2008 and may cancel their arrangements with Thorne –Leggett within 14 day.

If, however, arrangements are made within the confines of the Thorne-Leggett offices and subsequently the arrangements are cancelled by the client or if the client/applicant cancels after the 14 day cooling off period then Thorne-Leggett reserve right to charge a reasonable amount based upon the work carried out up to the time the cancellation is received.


Stationery

All funeral stationery must be approved for printing by 4 working days before the funeral to allow for it to be printed and delivered. Unfortunately no changes can be made after this point. If approval is not given or the stationary order is cancelled then Thorne-Leggett reserve the right to charge a reasonable amount based upon the work carried out up to the time the cancellation is received.


Data Protection

Thorne-Leggett will ensure that the data will be held securely, in confidence and processed for the purpose of carrying out our services. In order to provide our services we may need to pass such data to third parties and those third parties, who are performing some of the services for you, may contact you directly. We will not share any data with any third party not associated with the funeral arrangements.


Third Party Standards

Thorne-Leggett cannot be held responsible for the performance and reliability of the services provided third party’s not directly employed by Thorne-Leggett.


Grievances

As a member of the National Association of Funeral Directors (NAFD), Thorne-Leggett are bound by their Code of Practice. If a grievance cannot be resolved amicably between the client/applicant and Thorne-Leggett then details of the NAFD Resolve Scheme are available upon request.

How much does a funeral cost?

It is our policy to be open and informative about the funeral costs from the outset. Our costs are divided into three main groups.
